The annual meeting of the Harbor Pointe Property Owners Association was held on Wednesday, February 24, 2021 via web interface application, ZOOM.

Call to Order: HPPOA President Brian Heuser called the meeting to order at 7:03PM

The February 19, 2020 minutes were reviewed.

Public Comments – Lori Naylor inquired the status of installing fiber optic on Park Drive; Enrique Arevalos will revert with Twin Lakes to get Park Drive on the installation schedule when the Naylors commence construction.

An additional discussion included increasing annual dues; Atty D. Davis explained the Association requires 2/3 approval to increase dues. The Association sent a ballot vote to increase dues but fell short by 4 votes of the 50% +1 vote.


The Association has an opportunity to increase the assessment by taking another vote to change the declarations (50% +1 vote needed to pass rather than 2/3) prior to 01JAN2025, or the Association is locked in to the current declarations for another 10 years. To activate a Special Assessment, a 75% majority is required.


The Board will reconsider taking another vote to change the declarations, and to also include more definitive language regarding the prohibition of short-term rentals (e.g. VRBO/Air B&B). A 50% approval + 1 vote will be required to change the declarations.


Action Item: Brian Heuser will send out the Association’s bylaws & declarations to the current listing agents within the development.


Old Business – Enrique Arevalos – Fiber Optic Cable Installation Update

Twin Lakes has estimated the ”go-live” for high-speed internet (fiber-optic) time-frame for current clients to be April/May 2021.

There may be issues with Twin Lakes installing the main cable from the street pole to each house, underground. Twin Lakes cited there may be impediments running the cable underground due to terrain conditions.


New Business – Air B&B Rental Enforcement

Article 3 & Article 5 of the bylaws were briefly reviewed.

It was noted that a number of nuisance complaints were sent to President Heuser regarding prohibited leased properties, per HPPOA bylaws, within the Harbor Pointe development. Courses of action were discussed, including changing the current bylaws, sending notices to property owners indicating the prohibition of renting their property, issuing fines, and seeking injunctions.


Motion: Bill Sheriff: The Board will seek legal clarification regarding the prohibition of house rental and remedy regarding regulatory oversight within the scope of the current bylaws as written.
