MINUTES OF HARBOR POINTE PROPERTY OWNERS ASSOCIATION
FEBRUARY 19, 2020  The meeting of the Harbor Pointe Property Owners Association was held on February 19, 2020 at the home of Bill and Sharon Sheriff. Lot owners present were Enrique Arevalos, Paul and Lori Calkins, Catherine and Jim Kelly, Brian Heuser, Casey Kilmer, Jimmy and Vanessa Jones, Lori Naylor, Rory and Angie Lithgow, Julie Scobey, Sharon and Bill Sheriff and Sandy Weissend. It was noted that notice was sent by regular mail to all property owners of record of the meeting and that those present and by proxy (19) constituted a quorum for the meeting. Enrique, President of the Association, called the meeting to order.

The February 28, 2019 minutes were approved as submitted. 

Sharon Sheriff reported the Harbor Pointe Property Owner’s Association has an email address: harborpointepoa@gmail.com . The web site will be updated with current lot owner’s information.

 Jim Kelly, treasurer, presented the treasurer’s report. Jim explained the increase for property maintenance expense. He also commented regarding expenses for Park Drive repair as well as attorney fee’s associated with proposed changes in the Declarations of Reservations and Restrictive Covenants for Harbor Pointe at Center Hill Lake. Treasure’s report was accepted.

Term expirations on the Board of Enrique Arevalos and Jim Kelly as well as the resignation of Rory Lithgow were the next order of business. Sharon Sheriff made a motion for Vanessa Jones to be elected to the board, motion seconded by Brian Heuser, motion carried. Jim Kelley was nominated to remain on the board by Sharon Sheriff, seconded Julie Scobey, motion carried. Casey Kilmer was nominated by Rory Lithgow seconded by Brian Heuser, motion carried. Each of their terms is for 2 years, expiring 2022.

The next item of business was a discussion regarding the placement of the fiber optic cable by Twin Lakes in Harbor Pointe. Because of the rock, Twin Lakes has stated the only option was for the lines to go above ground or not installed. There was unanimous support from members present that the lines above ground would be acceptable rather than no fiber optic cable.

Enrique Aravelos then introduced HPPOA’s attorney, Derrick Davis. Derrick explained the need for revisions to the Declaration of Reservations and Restrictive Covenants for Harbor Pointe at Center Hill Lake that were written in 2000. The following points were covered: a) according to Dekalb County Road Superintendent, Harbor Pointe Drive is the only road owned by Dekalb county b) HPPOA is responsible for the repairs and maintenance of Park Drive, Harbor Court and Harbor Pointe Lane and c) without the ability to have assessments, there would likely be insufficient funds to fulfill the obligation. It was also explained the need to clear up certain ambiguities in the Declarations with the amendment regarding the collection and legal punishments, such as liens, for unpaid assessments. He then reviewed the proposed amendments to the Declarations. Discussion followed. Rory Lithgow made a recommendation to the board that the process to amend the Declaration of Reservations and Restrictive Covenants for Harbor Pointe at Center Hill Lake move forward as presented by Derrick Davis. It was noted that a letter and ballot will go out to all lot owners by certified, return requested mail. Recommendation was voted on and unanimously approved by those present in person and by proxy. 

There being no further business, the meeting was adjourned.
