MINUTES OF HARBOR POINTE PROPERTY OWNERS ASSOCIATION

FEBRUARY 28, 2019

The annual meeting of the Harbor Pointe Property Owners Association was held on February 28, 2019 at the home of Bill and Sharon Sheriff. Lot owners present were: Enrique and Sandy Arevalos, Joy Bidwell, Kyle and Jessica Hazel, Brian Heuser, Jim and Catherine Kelly, Rory and Angie Lithgow, Melanie Durham, Sharon and Bill Sheriff and Dave Smith. It was noted that notice was sent by email and/or regular mail to all property owners of record of the meeting and that those present and by proxy constituted a quorum for the meeting. Enrique, President of the Association, called the meeting to order.

The February 20, 2018 minutes were approved as submitted. 

 Jim Kelly, treasurer, presented the treasurer’s report. Discussion was focused on lot owners with delinquent dues. A recommendation was discussed to hire a lawyer to take legal action, not just letters, to collect dues plus legal fees from the delinquent lot owners. Treasure’s report was accepted.

The next item of business was a discussion regarding the road conditions and the issues with the county. A history of the county’s acceptance, as well as the county’s denials of having accepted, of the roads was given. In September 2007, after a search of the county records, it was determined that at the November 2006 county commission meeting, the county officially accepted the “main” Harbor Pointe Drive with no references to the three roads that branch off Harbor Pointe Drive (Park Drive, Harbor Court and Harbor Pointe Lane). Between November 2006 and September 2007, county officials and the road superintendent, on multiple occasions, denied that they had accepted the roads. It was noted that all roads are considered common roads of the association. A recommendation to pursue, starting with the planning commission, the acceptance of the 3 roads not yet accepted was discussed.

The next discussion centered upon a recommendation to the board to develop a set of rules and penalties/fines to more effectively carry out the “By laws “, “Restrictive Covenants” and other actions deemed necessary or prudent to protect the best interest of the association and its members.   

A motion was made, seconded and passed that the following recommendations be taken up by the board: 1) collection of delinquent dues by legal action, 2) clarification or action by Dekalb county to accept the three roads and 3) a set of rules and fines/penalties to better enforce the “By-laws and Restrictive Covenants of Harbor Pointe Association as well as other actions deemed prudent or necessary.

Term expirations on the Board of Sharon Sheriff and Kyle Hazel and the resignation of Jordan Asher were the next order of business. Catherine Kelly made a motion that Sharon and Kyle be re-elected to the board for 2 years term and Angie Lithgow be elected to replace Jordan Asher’s one year remaining term. Jessica Hazel seconded motion. Motion carried. Sharon and Kyle’s new will term expire 2021 and Angie’s in 2020. Dan Smith was asked to be on the ACC committee and he accepted. 

There being no further business, the meeting was adjourned.
